By accessing or using InvoisKit ("the Service"), operated by InvoisKit ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
InvoisKit is a software-as-a-service (SaaS) platform that provides Malaysian freelancers and small businesses with tools to:
3.1. You must provide accurate, complete, and current information when creating an account.
3.2. You are responsible for safeguarding your password and for all activities that occur under your account.
3.3. You must immediately notify us of any unauthorised use of your account by contacting us at support@invoiskit.it.com.
3.4. You must be at least 18 years old to use the Service.
You agree not to:
5.1. The Service offers a free tier with limited usage and paid subscription plans with additional features.
5.2. Paid subscriptions are billed monthly via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis.
5.3. All fees are stated in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise.
5.4. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
5.5. We reserve the right to change our pricing with 30 days' advance notice to existing subscribers.
6.1. The Service uses artificial intelligence (AI) to assist in generating proposal content. AI-generated content is provided as a starting point and may require review, editing, and verification by you before use.
6.2. You are solely responsible for reviewing, verifying, and approving all AI-generated content before sending it to clients or third parties.
6.3. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content for any specific purpose.
6.4. AI-generated proposals do not constitute legal, financial, or professional advice.
7.1. You retain ownership of all content you create using the Service, including proposals, invoices, and client data.
7.2. The Service, including its design, code, features, and branding, is owned by InvoisKit and is protected by intellectual property laws.
7.3. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription period.
8.1. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8.2. Sensitive data such as Tax Identification Numbers (TIN) are encrypted using AES-256 encryption before storage. We implement industry-standard security measures to protect your data.
8.3. We comply with the Malaysian Personal Data Protection Act 2010 (PDPA) in our handling of personal data.
9.1. The Service provides tools to create invoices. It is your responsibility to ensure that your invoices comply with all applicable Malaysian tax laws, including requirements set by the Inland Revenue Board of Malaysia (LHDN).
9.2. InvoisKit does not provide tax advice. Consult a qualified accountant or tax professional for tax-related matters.
9.3. SST (Sales and Services Tax) calculations provided by the Service are for convenience only. You are responsible for verifying all tax calculations.
10.1. To the maximum extent permitted by law, InvoisKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill.
10.2. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or RM 100, whichever is greater.
10.3. We are not liable for any loss or damage resulting from inaccurate AI-generated content that you chose to use without adequate review.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.1. We strive to maintain high availability of the Service but do not guarantee uninterrupted access.
12.2. We may temporarily suspend the Service for maintenance, updates, or security patches with reasonable notice when possible.
13.1. You may terminate your account at any time by contacting us.
13.2. We may suspend or terminate your account if you violate these Terms, with or without notice.
13.3. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.
You agree to indemnify and hold harmless InvoisKit, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
